MNEA takes stand on ‘firearms for teachers’ legislation

Senate Bill 656 creates significant safety concerns for students, parents and educational staff.

Missouri NEA, along with the Missouri PTA, has been in the news recently with the media coverage on Missouri’s firearms-for-teachers legislation, now awaiting Gov. Jay Nixon’s signature or veto.

The final version of Missouri Senate Bill 656 (Will Kraus), which the legislature passed this spring, includes language that grants authority for school districts to have teachers and other staff carry concealed weapons and assume an additional duty as a “school protection officer."

Missouri NEA leaders believe that any person carrying a weapon on school property should be a duly commissioned and dedicated law enforcement officer performing an authorized law enforcement duty.

MNEA supported House Bill 152, passed into law in 2013, to allow all school districts to choose to commission school police officers with the agreement of all overlapping local law enforcement agencies.

In contrast, S.B. 656 creates an unpaid, quasi-professional duty that is poorly drafted and fraught with profound school safety and employment concerns that may harm districts, employees and students.

  • School districts will not be able to obtain insurance to protect district patrons from the enormous financial liabilities incurred by designating these employees to carry concealed weapons.
  • Similarly, employees carrying concealed firearms will not be covered by personal liability insurance provided as a benefit by any educator association in this state.
  • Adopting such a policy would increase the number of guns present on school grounds and would increase the likelihood of gun-related accidents at school.
  • Adding additional weapon and enforcement-related duties to the responsibilities of full-time educators will likely be a distraction from these educators' main responsibility: to educate our students.
  • The bill allows these personnel to detain students and others for up to four hours for violations of law or school policy or rules, though these employees would still have their full-time education duties to perform during the time of such detention.
The bill does not specify how school districts will provide notice of who is carrying a concealed firearm. This could be serious issue of safety concern to students, parents and other educational staff.
